These Terms of Service ("Terms") govern your access to and use of Bouncr: the community-access, moderation, and subscription tools operated by The Bouncr LLC ("Bouncr", "we", "us"), including our bots, Mini App / embedded app, dashboards, and website (collectively, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Bouncr is a tool that lets community operators run token- and membership-gated communities on messaging platforms (currently Telegram and Discord). It reads public on-chain balances to determine eligibility, grants or revokes access to groups/servers, provides moderation and subscription features, and delivers notifications. Bouncr is a software tool; it is not a party to any community, does not take custody of any assets, and does not provide financial, investment, or legal advice.
A community operator configures access rules, moderation, roles, and subscriptions for their community. A member joins and interacts with that community. Operators are solely responsible for the rules they set, the content in their communities, and their compliance with applicable law. Bouncr provides the tooling; operators decide how to use it.
You agree not to: (a) break the law or infringe others' rights; (b) attempt to bypass access controls, gating, or security; (c) disrupt, overload, reverse engineer, or scrape the Service beyond normal use; (d) impersonate others or misrepresent your holdings or identity; (e) use the Service to distribute malware, spam, or unlawful content; or (f) violate the terms of Telegram, Discord, or any connected third-party service.
Community content is created by operators and members, not by Bouncr. Operators configure moderation (filters, blocklists, warnings, removals, and, where enabled, cross-platform message bridging). By using a community you consent to that community's configured moderation. Bouncr may act on content only as an automated tool executing an operator's configuration or to comply with law.
The Service integrates with third parties including Telegram, Discord, Stripe, WalletConnect, blockchain RPC and explorer providers (e.g. Etherscan), and, where you connect an account or a community gates on one, X, Google/YouTube, TikTok, Snapshot, and Human Passport. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
Where you connect a social account, you authorise us to read only the information described in the Privacy Policy, on your behalf, for the purpose of checking a requirement a community has set. We request read-only permissions and never post, like, follow, or send messages as you. You can disconnect any connected account at any time from your profile; doing so may make you ineligible for clubs that require it.
Third-party services may change, restrict, or withdraw their APIs at any time. Where that happens, a requirement that depends on the affected service may become unverifiable. In that case the Service treats the requirement as unknown rather than failed, and does not remove access on that basis alone.
Bouncr and its software, branding, and content are owned by The Bouncr LLC or its licensors. These Terms grant you a limited, revocable, non-exclusive licence to use the Service as intended. You retain rights to content you provide.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Bouncr does not provide financial, investment, tax, or legal advice. Token gating and on-chain reads depend on third-party networks and data that may be delayed, unavailable, or inaccurate. Digital assets are volatile and risky; you are solely responsible for your decisions.
To the maximum extent permitted by law, Bouncr and The Bouncr LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or assets, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amounts you paid us in the three months before the claim, or USD 100.
You agree to indemnify and hold harmless Bouncr and The Bouncr LLC from claims arising out of your use of the Service, your content, your communities, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or as needed to operate the Service. Provisions that by their nature should survive termination will survive.
We may update these Terms. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by notice through the Service. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in New Jersey, unless applicable law requires otherwise.
